The General Services Administration (GSA) had been in contact with the Bresler-Reiner Companies as early as May 1970 concerning construction of a privately-owned building in the southwest area of Washington, D.C. for the Environmental Protection Agency (EPA). In June 1970, the Bresler-Reiner Companies notified GSA that the Waterside Mall and Tower complex was under construction and should be ready for occupancy by September 1971. Although GSA continues to negotiate to have the lessor install a cafeteria at the mall complex, a cafeteria appears to be no closer to being operational than it was when the lease was agreed to in February 1971.

The lease provides that the cafeteria be installed in space not leased by GSA and be under the lessor's full control without cost to the Government. The Government has the right to install food facilities in the leased space, if deemed necessary. The lessor disagreed with various GSA positions on the cafeteria requirement; these disagreements have delayed resolution of the matter. The issue is currently pending before the GSA Board of Contract Appeals. EPA began to occupy the mall as the leased space was completed, beginning with 600 employees in August 1971.
