Concerned about the reach, cost, and impact of federal regulations on citizens and businesses, Congress passed the Small Business Regulatory Enforcement Fairness Act, which requires agencies to submit proposed rules to Congress and GAO. This gives Congress an opportunity to review rules before they take effect and to disapprove those found to be too burdensome, excessive, or duplicative. GAO's role is to provide Congress with a quick review of all major rules submitted to determine if the agencies have complied with the procedural steps governing the regulatory process. For rules that are determined to be "major," GAO must report to relevant congressional committees within 15 calendar days. This testimony discusses GAO's responsibilities under the act and the agency's experience in the 11 months since the law was enacted.
