Summary:

In response to a congressional request, GAO examined state controls over employee drug testing to determine the: (1) extent and nature of federal and state regulation of laboratories that perform employee drug testing; (2) extent of professional associations' or societies' guidance in regulating laboratories' quality and practice standards; and (3) effectiveness of U.S. drug-testing regulation and needed improvements.

GAO found that: (1) 11 states controlled drug-testing laboratories through specific statutes and regulations; (2) 15 states issued general medical or clinical laboratory statutes and regulations; and (3) although 24 states did not have any specific statutes or regulations governing drug-testing laboratories, the laboratories were affected by professional association guidelines, federal regulations, and state labor laws.
