Summary:

GAO discussed H.R. 3233 and its recently issued report concerning the administration of the Criminal Justice Act. GAO had reported that the 10 Federal district courts it reviewed often administered the act differently, especially when: (1) selecting private court-appointed attorneys; (2) controlling and accounting for funds; and (3) determining defendants' liability for legal costs. GAO noted that the Judicial Conference of the United States has already initiated or plans to initiate actions to implement all of the report's recommendations which address these problems. GAO generally supports H.R. 3233, although it has specific concerns about the provisions dealing with the establishment of maximum hourly rates for attorneys and increasing their maximum fees. GAO believes that these provisions should be studied further to determine whether each is needed.
