Summary:
An amendment to the interim alternative educational placement provision of the Individuals with
Disabilities Education Act (IDEA) has been proposed by Representative Livingston, added to the
Department of Education appropriations bill, H.R. 4274 , 105th Cong., 2d Sess., and
reported out of the House Appropriations Committee on July 20, 1998. The amendment would
change the current law by eliminating the current limitation of 45 days for an interim alternative
educational placement. In addition, the amendment would add a new subsection allowing schools
to place a child with a disability in an interim alternative educational placement if the child
intentionally exhibits violent behavior that has resulted or could have resulted in physical injury to
the child or others while at school or a school function. For a more detailed discussion of the
