Summary:
Federal involvement in the education of the handicapped increasedsignificantly with the enactment of the Education for All HandicappedChildren Act of 1975 (P.L. 94-142) in the 94th Congress. This legislationamended the provisions for State assistance under Part B of the Education ofthe Handicapped Act (EHA, P.L. 91-230, title VI, as amended) to require thata "free appropriate public education" be available for all handicappedchildren age 3 through 21 by September 1980. P.L. 94-142 authorizedincreased Federal financial assistance along with new requirements forparticipating State agencies and local school districts. Current issuesrelating to Federal policy for the education of the handicapped includeconcerns about costs and responsibilities in educating the handicapped, aboutthe level of Federal financial support, about the characteristics ofhandicapped children actually identified and served, about the implementationof P.L. 94-142 requirements by State and local school districts, and aboutAdministration proposals to revise Part B regulations.In addition, project grants authorized under the EHA, Parts C-F, expire atthe end of FY83. The Senate passed legislation that would reauthorize,expand, and amend these programs (S. 1341). Similar legislation has beenreported by a House committee (H.R. 3435).
