This report begins by reviewing the record of working conditions in the coal mining industry. Itthen describes the regulatory regime of the U.S. Department of Labor's Mine Safety and HealthAdministration, incorporating discussion of the standard-setting required by the MineImprovement and New Emergency Response Act of 2006. The practice in recent years of mineoperators contesting a greatly increased number of MSHA-proposed penalties for safety andhealth violations is next discussed in relation to the record at the UBB mine prior to theexplosion.
