Summary:

In the first session of the 109th Congress,Congress passed the Energy Policy Act of2005 (P.L. 109-58, H.R. 6), which authorizesappropriations from the Leaking UndergroundStorage Tank Trust Fund specifically for EPAand states to address releases of MTBE. Italso imposes new leak prevention requirementson EPA, states, and underground storagetank owners to better protect sources ofdrinking water. Section 322 of the energy actamended SDWA to preclude EPA from regulatingthe underground injection of fluids(other than diesel fuel) into drinking watersources for hydraulic fracturing purposesrelated to oil, gas, and geothermal production.
