Summary:
The President vetoed legislation (H.R. 976) that would have provided new federalfunding for the State Children's Health Insurance Program (SCHIP) in FY2008 throughFY2012. On September 29, 2007, the President signed a continuing resolution thatcontains a temporary FY2008 appropriation for allotments for SCHIP (H.J.Res. 52, P.L.110-92). Under this extension, SCHIP is appropriated the same amount for FY2008 thatwas appropriated for FY2007 ($5 billion), with the current-law formula used to allotthese funds among the states and territories. The current continuing resolution makes theFY2008 allotments available only through November 16, 2007. The FY2008 allotmentscan be available past November 16 only if new legislation is enacted. Based on states'projections, if the current FY2008 allotments were available through the end of FY2008,21 states would exhaust all available federal SCHIP funds during the fiscal year, withthe first states experiencing shortfalls in March 2008. This report provides projectionsof those states' shortfalls as well as projections of states' FY2008 allotments as wouldoccur under the vetoed H.R. 976 and new SCHIP legislation approved by the House,H.R. 3963, which is identical to the vetoed H.R. 976 in terms of the appropriations andformulas for SCHIP allotments.
