Summary:

This issue brief discusses various rail safety issues that either were considered or discussed during the 106th, 107th, or 108th Congress. Those include: whether the railroads should be required to develop fatigue management plans, whether changes in the hours of service requirements for railroad workers should be instituted, whether increased protection for railroad workers from alleged harassment and intimidation is needed, and whether federal efforts and FRA funding levels to improve grade crossing safety are adequate. Also, the option of simply reauthorizing current federal railroad safety law without any new requirements or authorities for FRA to implement is analyzed.
